Two legal questions. I'm not a lawyer so I'm asking or suggesting if/why two basic thing are route of pushing legal end to this insanity.
Parents have right to opt out and prevent sex ed. Okay. But does the state/parent have a right to label and provide false info. and/or refuse to provide true info. as SEX ED? It is fraud, bad science and dangerous. It leads to pregnancy, disease, and more rarely to death. Doing nothing is not a crime? But confusing a child to think the DO know facts and need not seek data -- Isn't this reckless endangerment? Especially of minors? Especially with "proof" from studies that it DOES NOT WORK. Teens pregnancies are more risky, abortion risky, and diseases also risk death. False data is fraud and that fraud does, however rarely, lead to damage/death.
Second path of legal attack, to me, is the reality that abstinence only mantra and materials are limited to ONE SLICE of religious thought. Funding it is "establishment" of one narrow religious view and therefore unconstitutional. Religious opinions of when body cells become a person range from conception to first breath. Religious opinions vary on same sex attraction. The mental health of gays is harmed by exclusion from sex ed -- thus targeting them for mental and physical risks of ignorance. It is thus "entanglement" of state educ. taxes in furthering one narrow slice of religious opinion.
(Third is that teachers with a different religious opinion are forced into conspiracy to commit this religious fraud. Constitution says "no religious test" for any "office...of public trust." That includes tax paid teachers. Teaching lies is against some religions -- "bearing false witness." )
I can't figure out how to get "standing" to sue to get it to Supreme Court. Retired and can't get pregnant. Wish someone else is able to get this stopped. Too bad our congressfolk are terrorized into this theocratic hateful crime.
